These terms are between you and Frankly Built LLC, a Florida company (“we”, “us”), and cover your use of the 18 Summers app. By using the app, you agree to them. They’re written to be read, so here they are in plain English.
The app
18 Summers helps you see the summers and weekends ahead with your kids, plan weekend adventures, and keep a log of the memories. You may use it for your own personal, non-commercial use on devices you own or control.
If you got the app from Apple’s App Store, Apple’s Licensed Application End User License Agreement (the Standard EULA, https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies. If you got it from Google Play, the Google Play Terms of Service also apply. If these terms and Apple’s Standard EULA disagree, the Standard EULA wins for App Store users.
Free and Premium
The summer countdown, the memory log, one kid, and up to 3 upcoming plans at a time are free.
18 Summers Premium adds unlimited kids, unlimited plans, plan reminders, and a printable memory book for each summer. Premium is an auto-renewing subscription:
- Plans: $19.99 per year or $2.99 per month in the United States. Prices in other countries are set by the App Store or Google Play and shown before you buy.
- Free trial: new subscribers may get a 7-day free trial when the store offers it. If you don’t cancel before the trial ends, the subscription starts and you’re charged for the plan you picked.
- Payment: charged to your Apple ID or Google Play account when you confirm the purchase, or when the free trial ends.
- Renewal: the subscription renews automatically for the same period and price unless you cancel at least 24 hours before the current period ends. Your account is charged for the renewal within the 24 hours before the period ends.
- Canceling: manage or cancel anytime in your App Store account settings or in Google Play > Payments and subscriptions. You can also tap Settings > Manage subscription in the app. Canceling stops the next renewal; Premium stays on until the end of the period you paid for.
- Refunds: Apple and Google handle payments and refunds under their own policies. We can’t issue refunds for store purchases directly.
- Price changes: if the price ever changes, the store will tell you first as its rules require.
Your stuff
Everything you add (names, birthdays, photos, plans, memories) is yours and stays on your phone. We don’t have a copy and can’t restore it if your phone is lost or the app is deleted. Your phone’s own backups may include it. Please don’t add anything you don’t have the right to use.
Weekend ideas are ideas
The app suggests activities, with a few safety tips. They’re suggestions from us, not professional advice. You know your kids and your area best: supervise, use good judgment, follow local rules (fishing licenses, fire rules, park hours and the like), and skip anything that doesn’t feel right. You’re responsible for the activities you choose.
Things you agree not to do
Don’t copy, resell or redistribute the app, try to get around Premium, or reverse engineer it except where the law allows.
No warranty
We work hard on the app, but it’s provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows. The summer and weekend counts are estimates based on the dates you enter.
Limitation of liability
To the fullest extent the law allows, Frankly Built LLC isn’t liable for indirect, incidental, special or consequential damages, or for lost data, arising from your use of the app. Our total liability for any claim about the app is limited to the amount you paid for it in the 12 months before the claim. Some places don’t allow these limits, so they may not all apply to you.
Changes and ending
We may update the app and these terms. If we make a significant change to these terms, we’ll update the effective date and, where it matters, tell you in the app. You can stop using the app at any time by deleting it (and canceling any subscription in your store account).
Law
These terms are governed by the laws of the State of Florida, USA, except where the law where you live says otherwise.
